1. One button, several names
The consumer’s right to change their mind about a distance purchase is the right of withdrawal, set out in the Consumer Rights Directive (2011/83/EU). Directive (EU) 2023/2673 — which amends that directive — created the “withdrawal function”: an electronic button to exercise that right. You will also see it called the “withdrawal button”, “cancellation button” or “right-of-withdrawal button”. It is all the same thing, and the rules are the ones below.
2. What the law requires exactly
To be compliant, the button (or link) must meet four cumulative conditions:
- Unambiguous label — something like “Withdraw from the contract” or “Cancel my purchase”, legible and prominent; burying it in a help menu does not count;
- Continuously visible and easily accessible throughout the whole withdrawal period — the 14 days counted from delivery, not just on the day of purchase;
- Two steps, no obstacles — the customer requests the withdrawal and confirms it; you cannot require account creation, a phone call or a justification;
- Automatic acknowledgement — the store must confirm receipt of the request on a durable medium (in practice, an email with date and time).
Offering only the official model withdrawal form as a PDF — which many platforms provide — is not enough. The form remains mandatory as an alternative, but the button is a new and separate requirement.
3. Who it applies to, and since when
The directive was published on 22 November 2023, Member States had to transpose it by 19 December 2025, and the rules apply to stores since 19 June 2026. It covers any online sale to consumers in the European Union — including stores based outside the EU that sell into it. If you sell strictly B2B, it does not apply to you; if you sell to consumers, it applies today.
4. What about the UK?
Post-Brexit, the directive does not bind domestic UK sales: those are governed by the Consumer Contracts Regulations 2013, which give consumers a 14-day cancellation right but do not require a withdrawal button. However, if your UK store sells to consumers in the EU, the button requirement applies to those sales — the directive follows the consumer, not the seller. For UK stores shipping to the EU, the practical answer is the same as for EU stores: add the button.
